1) General

a)‘The Boozie Brownie Company’ shall be referred to in these Terms & Conditions of Sale as the Seller and the purchaser or proposed purchaser shall be referred to as the Buyer
b)These Terms & Conditions shall take precedence over any terms to the contrary in the Buyer’s standard Terms & Conditions of purchase and, to the extent permitted by law, all other guarantees, conditions or warranties
c) These Terms & Conditions cannot be varied unless expressly agreed in writing by the Seller
d) All orders and other agreements between the Seller and the Buyer, whether in writing or verbal, shall be governed by the laws of England and Wales
e) No parties other than the Seller and the Buyer have any rights under these Terms & Conditions (and any agreement incorporating the same) pursuant to the Contracts (Rights of Third Parties) Act 1999

 

2. Pricing

a) Unless otherwise stated there is no VAT on any prices quoted

 

3. Delivery

a) The Seller will inform the Buyer as soon as possible after the order has been placed if any items are currently unavailable.
b) The Seller will dispatch orders on the specified dispatch date where the Buyer provides one.  If the Seller has not provided one, the Buyer will be entitled to a full refund.
c) The Seller is unable to accept any liability for the delivery date of products dispatched via Royal Mail’s standard 1stclass service, please note the Royal Mail delivery times are not a guaranteed service.
d) It is the customers responsibility to ensure that all delivery details given for the recipient are correct. The Boozie Brownie Co cannot accept any responsibility for losses or costs incurred in non-delivery to the Buyer in such circumstances.
e) If there is no suitable letterbox or safe place for the postal worker to leave the brownies, they will be returned to the local Royal Mail delivery office and a note will be left either indicating that redelivery will be attempted, or that the recipient must go and collect the parcel. The Boozie Brownie Company cannot accept responsibility for costs and/ or losses incurred if the recipient does not initiate contact with the Royal Mail to collect the parcel; this remains wholly the responsibility of the recipient. The Boozie Brownie Company strongly recommends the Buyer advises the recipient to expect a delivery.
f) The Boozie Brownie Company cannot accept responsibility for a delay in delivery due to adverse weather or an accident. In such cases an online credit will be issued in lieu of compensation, and a replacement box of brownies shall be issued.

 

4. Payment

a) All invoices are payable within the terms stated on the invoice or website, unless expressly stated otherwise
b) The Seller reserves the right to charge the Buyer interest at the rate of 2% per month, or part thereof, for any invoices, or part thereof, past due
c) The Seller reserves the right to claim from the Buyer any costs that may be incurred in collecting full payment including, but not limited to, debt recovery agents’ charges and solicitors’ fees

 

5. Queries

a) All queries regarding products or services supplied must be e-mailed to info@booziebrownies.co.ukwithin 2 days of receipt
b) All queries regarding quantities or prices must be e-mailed to info@booziebrownies.co.ukwithin 2 days of receipt of the invoice

 

7. Complaints

a) Hopefully you won’t ever have any reason for complaint, but if so please direct towards info@booziebrownies.co.uk within 2 days of receiving the brownie box. Please note any compensation will not exceed the amount originally paid for the brownies.

 

8. Liability

a) In no circumstances shall the Seller be liable for consequential loss or damage howsoever arising as a direct or indirect result of any failure or defect, or alleged failure or defect, with products or services supplied
b) The Buyer shall indemnify the Seller in respect of all damage, injury or loss to any person or property and against all actions, suits, claims, demands, charges or expenses in connection therewith arising from the condition or use of the products or services where they have been occasioned partly or wholly by the actions of the Buyer or his servants, invitees or agents or by any breach by the Buyer

 

9. Confidentiality

a) The Buyer shall treat as strictly confidential and not divulge to any third party any information provided by the Seller and marked as being confidential (or words having similar effect)
b) The Buyer undertakes to ensure that its authorised users of the Seller’s online ordering system(s) shall not divulge or allow to be divulged any usernames, passwords or other online ordering access information to any person whatsoever

 

10) Website content

a) The Boozie Brownie Company has taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and all products have been accurately and fairly described. Packaging may vary from that shown. We have made every effort possible to display as accurately as possible the colours of our products that appear on the website, however as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the of the product on delivery.
b) The Boozie Brownie Company reserves the right to change the decoration on the brownies with an appropriate substitute of equal appeal and quality.
